  1. Preliminary provisions
    1. The Regulations define the rules for the provision of services by 96MOTO Adrian Gwoździk to Users consisting in enabling the posting of advertisements on the 96MOTO Website in the field of the motorcycle industry.
    2. The Regulations have been prepared on the basis of the Act of July 18, 2002. on the provision of electronic services (i.e., Journal of Laws of 2017, item 1219) and other applicable legal acts.
    3. The condition for accessing the functionality of the 96MOTO Website is the use of a device communicating with the Internet and equipped with a commonly used web browser.
    4. In order to use any functionalities of the Website, apart from browsing available ads and contacting the person or entity publishing the advertisement (advertiser), it is necessary to register a User Account, and then log in to this account and use the Website as a Registered User.

    2. 96MOTO Website or Website - online advertising website under the name 96MOTO, run by the Operator in Polish or in the language of a given country, enabling posting and viewing Advertisements, available in the internet domains 96moto.com, 96moto.eu, 96moto.com.pl, 96moto .pl
    3. Advertisement - an advertisement prepared by the User, placed on the Website, under the conditions provided for in the Regulations.
    4. User - a natural person who is at least 18 years old and has full legal capacity, a legal person or an organizational unit without legal personality but able to acquire rights and incur obligations on their own behalf, who created the Account in the manner provided for in the Regulations.
      • The "full name" entered during registration will be visible in the ads placed as the issuer. The full name can be changed in the My Account panel.
      • The "User" provided during registration will be used to log into the service, the name is unique, assigned to the email address provided during registration, it is not possible to change the User name.
    5. Visitors - a User who browses ads without registering a User account.
    6. Account - assigned to a given User, identified by means of an email address and User Name, a part of the Website by means of which the User may perform specific actions on the Website.
    7. Service of Using the Website - a service that the Company provides to Registered Users, which means that Registered Users can use the Website. Use requires User registration. The service includes the service of placing advertisements, as well as Users' communication with Visitors and the Company.
    8. Advertisement Placement Service - a service consisting in enabling a Registered User to place an advertisement on the Website for the period of time indicated in the Regulations.
    9. Consumer - a consumer within the meaning of the Civil Code.
    10. Account Block - suspension or withdrawal of access to the User's account, i.e. withdrawal of access to the User's account on the Website, provided for in the Regulations, which is not deleted, resulting in:
      • blocking access to the User's panel along with the withdrawal of access to functionalities and services for which access to the panel is necessary,
      • blocking all User's ads.
    11. Deleting an advertisement - a situation in which an advertisement is not displayed on the Website, but is not removed from the User's account.

  3. General conditions of using the Website
    1. Using the Website is voluntary and free in terms of access to published ads.
    2. The service provider may introduce payment for part of the services rendered. The amount of the payment is each time specified in the price list of paid services constituting Annex 3 to these Regulations.
    3. The advertisement comes from a User who sets its content independently and on his own responsibility. The User is responsible for the compliance of the content of the advertisement with the factual and legal status.
    4. The advertisement is an offer composed by the User from a text, illustration or photo regarding a legal or factual act marked in the content.
    5. Announcements are available to all Internet users. Contact with the User posting an advertisement is possible via the contact form, which allows anyone, after providing their Name and Surname, e-mail address and the content of the Message, to send a message to the e-mail address assigned to the User's Account.
    6. Publication of the Advertisement on the Website is payable in accordance with the principles set out in the Price List for paid services constituting Annex 3 to these Regulations. The Operator may allow placing free advertisements on the terms set out separately in the Price List referred to above.
    7. The User is responsible for published content (including photos) and guarantees that they are consistent with the facts and law and their publication does not infringe the Operator's rights, these Regulations and the rights of third parties, including in particular copyright.
    8. The content of the Advertisement should be unambiguous and not misleading other Users.
    9. The Operator protects Users' data in accordance with the privacy policy set out in Annex 1 to the Regulations, which constitutes its integral part.
    10. Downloading or using in any scope available on the Website 96MOTO the materials require the Operator's consent each time and may not violate the provisions of the Regulations and generally applicable law, as well as may not violate the Operator's interests. Any aggregation and processing of data and other information available on the Website is prohibited 96MOTO in order to further share them with third parties on other websites and outside the Internet.
  4. Account creation
    1. Placing an Advertisement requires the User to read and accept the Regulations, together with Annexes, fill out the registration form and create an Account.
    2. If the form referred to in point 1 is completed, the Operator will send a return message to the e-mail address provided by the User enabling activation of the Account and containing information required by law.
    3. Creating an Account provides the User with full access to registered data and published Advertisements.
    4. Creating an Account is tantamount to concluding an agreement between the User and the Operator regarding the provision of services under the conditions provided for in the Regulations.
    5. In the case of legal persons and organizational units, only an person who is authorized to act in this area on behalf of these entities may create an Account on their behalf and perform any further actions on the Website.
    6. The User may have and use only one Account on the Website.
    7. It is prohibited to create accounts with both the Full Name/Nickname on the portal and the User with the name 96MOTO and related names, which could indicate that the account belongs to the Portal Administrators and threaten the good name of the Portal. 
    8. It is not allowed to use temporary email addresses, both to create an Account and to place an Advertisement.
    9. The provision of services by the Operator under the Website Account is perpetual. The User may delete the Account at any time, which shall be equivalent to the termination of the contract with the Operator. It can do this by sending an e-mail from the e-mail address that is assigned to the User's Account or by means of a written statement.
    10. The user who is a consumer may, within 14 days from the conclusion indicated in part IV. point 4 of the contract, withdraw without giving any reason. The rules of withdrawal from the contract, including the model withdrawal form, which the User may use, constitute Annex 2 to the Regulations. Withdrawal from the contract on the terms indicated above is not possible if the User posted an Advertisement before the expiry of the 14-day period, and thus the provision of the service by the Operator has started.
  5. Posting and editing Announcements
    1. Posting an Advertisement on the Website 96MOTO It requires:

      • completing the form available on Website pages 96MOTO, including in particular placing the content of the Announcement and attaching photos / drawings, etc.
      • Activation of the Ad is done automatically after payment (applies only to paid categories and ad publication times) or after saving the Ad (in the case of free ads).
      • The advertiser can select the "Buy now with PayPal" option if he/she has an e-mail address also registered in PayPal in his/her profile.
      • In his advertisement, the Lister can activate an Auction, in which he can set: Starting Price, Minimum Price, Minimum Bid, Maximum Bid. The auction duration is the same as the selected announcement publication time.
      • The advertisement may be published only in Polish, English, Czech, Slovak, Slovenian, Italian, French, Ukrainian, Spanish, German and Romanian.
      • Posting social advertisements is not allowed,
      • during the period of issue of the Announcement, the User may modify the content of the Announcement or delete the Announcement (in the case of paid announcements - the fee paid is not refundable).
    2. It is forbidden to:

      • placing on the Website, as well as providing through it, materials and content contrary to applicable law, principles of social coexistence and decency; material and content: vulgar, obscene, pornographic and erotic, commonly considered offensive, violating the personal rights of others, inciting and inciting to commit a crime, promoting violence, racism and morally reprehensible;
      • placing on the Website ads: erotic, social and matrimonial, as well as regarding: gambling, alcohol, tobacco products, drugs or prohibited measures with similar effect, prescription drugs, software in violation of the principles of copyright protection, weapons and ammunition and other prohibited by Polish law or international.
  6. Rules of responsibility

    1. The Operator enables Users to place Advertisements on the Website 96MOTO and does not interfere with the content of the Announcements, subject to the provisions below.
    2. The User undertakes not to place Announcements containing content that violates applicable law or the rights of third parties, in particular the announcements referred to in Part V point 2 of the Regulations.
    3. The Operator is not responsible for the compliance of the offer with the actual state and the truthfulness and reliability of the information contained in the announcement by the User.
    4. The Operator does not participate in concluding contracts by Users, and does not charge any fees or commissions for this. The operator is not responsible for the reliability of people using the Website. Users make transactions at their own expense and risk.
    5. The Operator is not responsible for improper performance or non-performance by the Parties of contracts concluded in connection with the posted Advertisement. Therefore, it is not responsible for any damages resulting from the use of the advertisement. He also does not participate in disputes arising between the Users of the portal.
    6. Presented on the Website 96MOTO announcements and their content do not constitute an offer within the meaning of art. 66 of the Civil Code.
    7. The Operator has the right to delete the Advertisement if it violates the provisions of the Regulations or the law in any way, in particular if it contains the content:
      • widely considered offensive,
      • bearing signs of acts of unfair competition,
      • violating decency, copyright or other intellectual property rights,
      • damaging the good name or reputation of the Operator.
      • misleading.
      • which are used to extort payment for the offered item and failure to complete the transaction with the Buyer
    8. The operator has the right to:
      • improve the category of the posted advertisement if it finds that the advertisement is in the wrong category.
      • delete an Ad if, during the issue of an Ad, the User changes the subject of an Ad that is clearly inconsistent with the original publication of the Ad. Publication costs will not be reimbursed.
      • deleting each Announcement or blocking the Account if there is a suspicion that actions through the Announcement or Account may or may endanger the safety of other Users on the Website. Similarly, in the case where the Announcement negatively affects the good name of the Operator or otherwise harms the Operator.
    9. It is forbidden to:
      • during the publication of a given Announcement and during its duration, changing the subject of the announcement.
    10. The operator is not responsible for:
      • no interest in the subject of the Advert,
      • implementation of Users' obligations arising from legal provisions,
      • force majeure, ICT systems or devices independent of the Operator,
      • statements submitted by the User.
  7. Complaint procedure
    1. The User may lodge complaints regarding non-performance or improper performance by the Operator of services provided under the Regulations, immediately after they have been found.
    2. Complaints can be submitted via e-mail to the following address: This email address is being protected from spambots.     3. The complaint should contain at least: name and surname, username, User's email address assigned to the Account or address for written correspondence, id number of the Announcement to which the complaint relates or other data enabling identification of the Announcement, issue period, circumstances justifying the complaint, and also specific User's request related to the submitted complaint.
    4. The operator will consider the complaint within 14 days from the date of receipt of all necessary data from point 3. The User will be informed about the method of handling the complaint by electronic mail, to the e-mail address assigned to the Account, and in the case of complaints submitted in writing - to the indicated address for delivery.
  8. Miscellaneous
    1. The Regulations are available on Website 96MOTO, as well as sent via e-mail to the User's e-mail address in cases required by relevant legal provisions.
    2. The Operator will inform about the change in the Regulations by posting information on the Website 96MOTO.
    3. Unless the mandatory provisions of law provide otherwise, the law applicable to the entire contract between the User and the Operator, the subject of which is the provision of services by the Operator under the conditions set out in the Regulations, is Polish law.
    4. All disputes related to services provided by the Operator as part of the Website 96MOTO will be settled by competent Polish common courts.
    5. Users who are consumers have the option of using an out-of-court complaint and redress procedure before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Katowice.
    6. The operator may make changes to the Regulations. The changes may be dictated by changes in the technological, legal, economic or organizational scope of the Operator's operations, as well as changes in the structure of the Website.
    7. Any changes to the Regulations will be posted on the Website and will become effective within 14 days of notifying Users of the changes, including by publishing the Regulations in new content on the Website, with notification of the content of the changes.

Appendix 1

PRIVACY POLICY

The operator "96MOTO Adrian Gwoździk" respects the right to privacy of the Users of the 96 websiteMOTO In particular, it protects their personal data and applies appropriate organizational and technical solutions to prevent interference with Users' privacy by third parties. The actions are aimed at guaranteeing the User a sense of full security at the level appropriate to applicable law, including:

  • Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation);
  • Act of 18 July 2002 on the provision of electronic services,
  • Act of 16 July 2004 Telecommunications Law.

Using the Website 96MOTO is implemented using a secure SSL protocol, which significantly increases the protection of data transmission over the Internet.

 

Please be advised that as part of the Website, external links may be posted enabling its Users to directly reach other websites. Each of the suppliers sets out the rules for the use of cookies in their privacy policy, therefore we have no influence on the privacy policy of the suppliers and the use of cookies.

Glossary of terms:

  • cookie - this is small information saved by the server on the User's computer, which the server can read when reconnecting from this computer,
  • system log - this is the information that the User's computer transmits to the server at each connection, it can contain various data (e.g. IP number), from which it is possible to determine more or less precisely where the connection came from,
  • IP address - an individual number, which usually has every computer connected to the Internet, the IP number can be permanently associated with the computer (static) or assigned to a given connection (dynamic),
  • SSL protocol - a special standard for transmitting data on the Internet, in which transmission is encoded, unlike ordinary transmission, where transmission is carried out in open text.

    We store data regarding the User's use of the Website provided directly by the User regarding registration and account information. In order to use the Services we provide, we may collect the following information:

    1. Under the account type: Company:
      • full name,
      • e-mail address (e-mail address),
      • e-mail address for PayPal (e-mail address registered in the PayPal system),
      • Phone number
      • company address and name,
      • number nip.
      • user name
    2. Under account type: Private person:
      • full name
      • e-mail address (e-mail address),
      • e-mail address for PayPal (e-mail address registered in the PayPal system),
      • Phone number
      • user name

Providing the above data is necessary to use the services offered as part of the account on the Website 96MOTO

When using our Services, the User may also voluntarily provide the following additional personal data:

  • address
  • another phone number

In the case of e-mail contact, we collect all information that the User decides to provide during correspondence with our employees or representatives.

Providing the data indicated above is voluntary, but without providing it, it may not be possible to use the Website in terms of functionalities that require it (e.g. publication of an advertisement).

 Data collected automatically when using the Website Services by the User are http queries directed to the server. Browsed resources are identified by URL addresses. The list of information stored in the web server log files is as follows:

  • the public IP address of the end device from which the request came,
  • name of the User's station - identification carried out by the http protocol, if possible,
  • User name provided in the authorization process,
  • time of receipt of the inquiry,
  • First line of http request
  • http response code,
  • the number of data sent by the server,
  • URL address of the page previously visited by the User (so-called referer link) - if the Website was accessed via an external link,
  • information about the User's browser,
  • information about errors that occurred during the implementation of the http transaction.

The above data are not associated with specific people browsing the Website.

The website does not automatically collect any information except for information contained in Cookies. The information collected in this way is used, among others down:

  • Website management,
  • identifying possible security threats,
  • surveys of aggregate traffic of Users within the Website and for statistical purposes.
  1. Processing of personal data

The data related to the User collected through the Website may be used to determine the adaptation of the content of the Website to the needs of the User and to answer the query directed by the User using the contact form.

The Users' personal data collected is not transferred to third parties or international organizations or to third countries. Personal data may be processed by other entities in accordance with Union or national law.

Personal data collected through forms that the User has agreed to are processed for the purpose and period necessary to properly handle the task.

The User has the following rights in the processing of his data:

  • access to data;
  • rectification of data;
  • deletion or limitation of processing;
  • lodging a complaint to the supervisory body regarding the protection of personal data - the President of the Office for the Protection of Personal Data;

Personal data will be stored for the duration of the services provided by the Administrator and for the period resulting from the limitation period for claims, consumer rights, bookkeeping or other rights in this regard;

In connection with the processing of personal data by the Administrator, the person giving consent to share the data has the following rights, of which he should be informed:

  • the right of access, i.e. the right to information which personal data concerning a given person are processed by the Administrator and to receive a copy of this data,
  • the right to request that the data be rectified if the data being processed becomes out of date or incomplete (or otherwise incorrect);
  • the right to request the deletion of personal data when they cease to be necessary for the Administrator for the purposes for which they were collected or when the authorized person withdraws consent to the processing of data (unless the Administrator has the right to process data on a different legal basis) or if the processing occurred unlawfully;
  • the right to transfer data to another administrator in the event that personal data are processed by the Administrator on the basis of consent to processing or for the purpose of performing a contract concluded with the Administrator;
  • the right to object to data processing when the Administrator processes personal data, including in order to conduct marketing activities regarding its products and services or when the basis for data processing is the premise of the legitimate interest of the administrator.
  • The right to withdraw consent to processing - consent can be withdrawn at any time in an email sent to the Administrator. In this situation, the processing activities carried out before the withdrawal of consent will remain lawful, and after the withdrawal of consent, the Administrator will not be able to process personal data for the purposes for which he obtained consent;
  1. Use of cookies
    Service, in accordance with art. 173 of the Telecommunications Act of 16 July 2004, uses Cookies that constitute IT data, in particular text files, which are stored on the User's end device. Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.
    Cookies are used to:
    • facilitate the User to use the Website while browsing;
    • later association of the User in the case of a re-connection of the Website with the device on which they were saved;
    • creating statistics that help to understand how Website Users use websites, which allows improving their structure and content;
    • adjusting the content of the Website to specific User's preferences and optimizing the use of websites tailored to the User's individual needs.

    As part of the Website, we use the following types of Cookies:
    • "Session" and "persistent" cookies. Session cookies are temporary files that are stored on the User's end device until logging out, leaving the website or turning off the software (web browser).
    • Persistent cookies are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User.

    The information is in no way combined with the Website User's personal data and is not used to determine the User's identity. The scope of information collected automatically depends on the User's web browser settings. Users should check their browser settings to find out what information is provided by the browser automatically or to change these settings.

    Software for browsing websites, i.e. a web browser, usually by default allows storing Cookies on the User's end device. Website Users can change the settings in this regard. The web browser allows you to delete cookies. It is also possible to automatically block cookies. If the User does not want to receive Cookies, he can change the settings of his browser. However, disabling Cookies necessary for authentication processes, security or maintaining User preferences may hinder or, in extreme cases, prevent the use of the Website.

            You have the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 14 days from the date of the contract. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or email). You can use the model withdrawal form, but it is not mandatory.

            To meet the deadline to withdraw from the contract, you only need to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.

  2. There is a possibility to distinguish ads on the Website, all distinctions are paid according to the table below. Promotions can be combined:
    1. "First" promotion - The advertisement will be published first on the list of ads in a given category, with this priority being absolute at the time of publication.
    2. "Bold" promotion - The ad will be published in bold on the list of ads.
    3. Promotion "Frame" - The advertisement will be published with a distinguishing frame on the list of ads.
    4. Promotion "Background" - The announcement will be published with a highlighted background on the list of announcements.
    5. "Featured" promotion - The advertisement will be published in the module displaying advertisements highlighted on the home page (minimum 1 photo is required in the advertisement). A characteristic star will appear next to the name of the advertisement, suggesting the uniqueness of the advertisement. This promotion does not affect the order in which the ads are displayed.

  3. On the website, it is possible to highlight the offer by means of the "move to the top of the list" option available in the my ads panel, available below each active advertisement. "Move to the top of the list" - has a lower priority than the "first" promotion (so if we set up an advertisement with the "first" active promotion, and then in another advertisement we use the "move to the top of the list" option, it will actually work out under the advertisement with the "first" promotion active, unless the transferred advertisement also has the first promotion, it is then placed at the very top of the list.)

  4. When adding an announcement, you can choose the Ad Type as "URGENT" when adding an announcement, this option is payable at 7,00 PLN or 7 points.
  5. It is possible to add 30 photos on the website free of charge.
  6. All payments are handled by Przelewy24, PayPal and PayU. By making a payment, you accept the terms and conditions of each operator's Regulations.
  7. Advertisement on portal 96MOTO 
    The portal provides space for advertising for entities wanting to promote a product, company, service or other in a special advertising panel.

    • Home page and all subpages
    Advertising prices are set individually and depend on:
    • the number of days the ad was published
    • forms of advertising
    • quantity / size of advertising materials

Electronic invoices

  1. Each User who wants to receive a VAT invoice is asked to report this fact by e-mail from the e-mail address to which the account on the Portal is assigned.
  2. The invoice will be sent to the e-mail address within 48 hours.
